Terms and Conditions
Last updated: 29/07/2026 — Version: 1.0
These Terms and Conditions (“Terms”) govern your download, installation and use of the Bot Marley WordPress plugin (the “Plugin”), in both its free and paid (“Pro”) versions, and your purchase of a Pro licence.
The Plugin is provided by BigFive Srl , with registered office at Via Appiani 18 – 20900 Monza (MB) Italy, VAT/tax number IT07998680966, trading as BigFive (“BigFive”, “we”, “us”, “our”).
By installing, activating or using the Plugin, or by purchasing a Pro licence, you (“you”, the “Customer”) accept these Terms. If you do not accept them, do not install or use the Plugin.
1. Definitions
- Plugin — the Bot Marley software for WordPress, including the free and Pro versions, together with any updates we make available.
- Free version — the version of the Plugin distributed at no charge.
- Pro version / Pro — the paid version, unlocked by a valid Licence Key, which enables additional features.
- Licence Key — the unique key issued on purchase that activates Pro features and entitles you to updates and support.
- Site — a single WordPress installation (one domain or subdomain) on which the Plugin is activated.
- Subscription — a recurring (typically annual) payment plan for a Pro licence.
- AI Provider — the third-party AI service (for example OpenAI, Anthropic, Google Gemini, Mistral) that you connect to your own WordPress installation and that processes requests generated by the Plugin.
- Reseller — Freemius, Inc., which acts as our authorised reseller and merchant of record for purchases of Pro licences.
2. The Plugin
Bot Marley is a self-hosted WordPress plugin. It indexes the content you select on your own Site, stores that index in your own WordPress database, and answers visitor questions using only that content, through the AI Provider you connect.
We do not operate a chatbot backend, we do not host your knowledge base, and we do not receive, store or process your visitors’ conversations on our servers. The Plugin runs entirely on your hosting.
3. Licence and intellectual property
3.1 GPL licence
The Plugin — free version and Pro version alike — is free software distributed under the GNU General Public License, version 2 or (at your option) any later version (“GPL”), a GPL-compatible free software licence as listed by the Free Software Foundation (list of compatible licences). A copy of the GPL is available at gnu.org.
Under the GPL you are free to use, study, modify and redistribute the Plugin’s code, subject to the terms of that licence. Nothing in these Terms limits, restricts or overrides the rights granted to you by the GPL. Where any provision of these Terms conflicts with the GPL in relation to the Plugin’s code, the GPL prevails for that code.
3.2 What the Licence Key is for
A Pro Licence Key is not a restriction on your GPL rights over the code. It is your entitlement to the commercial services we attach to the Pro version, namely:
- access to automatic updates of the Pro version;
- access to customer support as described in Section 8;
- activation of Pro features on the number of Sites covered by your plan.
If your Licence Key expires or is not renewed, you may continue to use the version of the Plugin you have already installed, but you will no longer receive updates or support, and Pro features may stop being activated by the Plugin’s own licensing mechanism.
3.3 What is not covered by the GPL
The GPL applies to the Plugin’s code. It does not grant you any right to use our trademarks, trade names, logos or brand assets — including “BigFive” and “Bot Marley” — beyond what is necessary to describe the software accurately, nor any right in our website content, documentation, images or design assets, which remain our property or that of our licensors.
3.4 Relationship with the Reseller’s EULA
Your purchase is also covered by the End User Licence Agreement published by our Reseller, Freemius, on the product page. That EULA contains generic restrictions on copying, modifying, redistributing, reverse engineering and creating derivative works of software sold through the platform.
Those restrictions do not apply to Bot Marley. The Plugin is distributed under the GPL, and the Reseller’s EULA expressly provides that where the software is subject to the GPL, you may use it in accordance with the GPL and may disregard any provision of that agreement which conflicts with the GPL. Section 3.1 of these Terms therefore prevails: your rights to use, study, modify and redistribute the Plugin’s code are those granted by the GPL.
4. Purchase, prices and payment
4.1 Merchant of record
Pro licences are sold through our authorised reseller Freemius, Inc., which acts as merchant of record. Freemius handles checkout, payment processing, invoicing and applicable taxes. Purchases are therefore also subject to Freemius’ own terms and to the product EULA and policies published on the Freemius product page. We do not collect or store your payment card details at any time.
4.2 Which document governs what
Two documents apply to a Pro purchase, and they cover different things:
- the Reseller’s EULA governs the purchase transaction — payment, invoicing, taxes, chargebacks and the platform’s own standard licence terms;
- these Terms govern the relationship between you and BigFive in respect of the Plugin itself — the licence position under the GPL, support, the AI Provider dependency, our commitments on discontinuation, and our money-back guarantee.
Where the two documents differ, the provision that is more favourable to you applies to any commitment we make in these Terms, and these Terms prevail as between you and BigFive on the subjects listed above. Nothing in the Reseller’s EULA reduces the commitments we give you in Section 5 (money-back guarantee) and Section 10 (discontinuation), which are our own contractual undertakings.
The free version is not sold and is not covered by the Reseller’s EULA at all: it is governed solely by the GPL and by these Terms.
4.3 Prices and taxes
Prices are those displayed on our website or at checkout at the time of purchase. Unless stated otherwise, prices are exclusive of VAT and any other applicable taxes, which are calculated and charged at checkout according to your location.
We may change our prices at any time. A price change never affects an order already placed. For active Subscriptions, any change to the renewal price will be communicated in advance and will apply from the following renewal.
4.4 Subscriptions and renewal
Pro licences are normally sold as annual Subscriptions that renew automatically at the end of each term, at the renewal price then applicable to your plan, until cancelled.
You can cancel automatic renewal at any time from your customer portal. Cancellation stops future charges; it does not, by itself, entitle you to a refund of the current term (see Section 5). After cancellation you keep Pro entitlements until the end of the paid term.
5. 30-day money-back guarantee
We offer a 30-day money-back guarantee on the first purchase of a Pro licence.
- If you are not satisfied, request a refund within 30 days of the purchase date and we will refund the amount paid in full.
- Requests can be made from your customer portal or by contacting us at [SUPPORT EMAIL].
- Refunds are processed by our Reseller to the original payment method. Bank or provider processing times are outside our control.
- Upon refund, your Pro licence is deactivated and your entitlement to updates and support ends. Consistent with Section 3.1, we will not disable or remove software already installed on your Sites.
- The guarantee applies to the initial purchase. Renewals are not automatically covered, but if a renewal was charged unexpectedly, contact us promptly and we will consider the request in good faith.
This commercial guarantee is offered in addition to, and does not affect, any statutory rights you may have as a consumer (see Section 14.2).
Our guarantee is broader than the Reseller’s standard policy. The Reseller’s EULA provides for a refund within thirty (30) days only where a defect makes the software’s material functions unusable and support has been unable to resolve it, and excludes cases such as incompatibility with third-party software or missing features. We do not apply those limitations. The guarantee in this Section 5 is a no-fault commitment: within 30 days of your first purchase you may request a refund for any reason, including simply deciding the Plugin is not right for you. If the Reseller declines a request under its narrower policy, contact us at [SUPPORT EMAIL] and we will arrange the refund.
6. Your responsibilities
You are responsible for:
- Your AI Provider account. The Plugin does not include AI capacity. You must create your own account with an AI Provider, obtain your own API key, and comply with that provider’s terms. All costs charged by the AI Provider for indexing and answering are yours, are billed directly to you by that provider, and are outside our control. We have no visibility of, and accept no responsibility for, your consumption or your bill.
- Your API keys and credentials, which are stored in your own WordPress installation and never transmitted to us.
- Your hosting environment, including meeting the minimum requirements published in our documentation, and maintaining backups.
- The content you index, including holding the necessary rights to it, and choosing what to exclude.
- How you configure the bot, including its objectives, tone and any content the bot is instructed to promote.
- Compliance with applicable law in your use of the Plugin — in particular data protection law in respect of your website visitors, consumer and advertising law, and any sector-specific rules that apply to you.
7. Third-party AI providers
The Plugin sends the visitor’s question, together with the relevant excerpts of your indexed content, to the AI Provider you select and control. That transmission, and any processing performed by the AI Provider, is governed by your agreement with that provider.
You acknowledge that:
- availability, performance, rate limits, pricing and model behaviour of the AI Provider are entirely outside our control;
- AI-generated answers may be inaccurate, incomplete or unsuitable for a given purpose, notwithstanding the grounding mechanisms implemented in the Plugin;
- the Plugin’s output must not be relied on as legal, medical, financial or other professional advice;
- if you need a specific data-processing arrangement (for example EU data residency), you must select an AI Provider that offers it and enter into the relevant agreement directly with that provider.
8. Support
While your Pro licence is valid, we provide support by email or through the ticketing channel indicated on our website, in English and Italian, on business days, on a reasonable-effort basis.
Support covers installation, configuration and defects of the Plugin. It does not cover: custom development, modifications you or third parties have made to the Plugin’s code, conflicts caused by other plugins, themes or hosting configurations, migrations, general WordPress administration, or issues originating with your AI Provider.
The free version is provided without any support obligation. We may, at our discretion, answer questions from free users through public channels.
9. Acceptable use
You must not use the Plugin to build or operate a service that is unlawful, that infringes third-party rights, that deliberately misleads users about the automated nature of the assistant where disclosure is required, or that circumvents the Plugin’s licensing mechanism in order to obtain updates or support you have not paid for.
Circumventing the licence check does not deprive you of your GPL rights over the code, but it is a breach of these Terms and may lead to termination of your entitlement to updates and support under Section 12.
10. Availability, changes and discontinuation of the Plugin
10.1 Right to modify or discontinue
We develop the Plugin on an ongoing basis. We may, at our sole discretion and at any time, modify, suspend or permanently discontinue the Plugin or any of its features, in the free version, the Pro version, or both, including ceasing the sale of new licences, ceasing the publication of updates, and ceasing support.
Where reasonably possible, we will give advance notice by email to Pro customers and by a notice on our website.
10.2 What happens if we discontinue
If we suspend or permanently discontinue the Plugin, or any version of it, the following commitments apply:
- Refunds. We will honour any refund request relating to a Subscription in progress, and we will do so beyond the 30-day window of Section 5. Depending on the circumstances, we will refund the current term in full or on a pro-rata basis for the unused portion, whichever is more favourable to you. Automatic renewals will be stopped.
- No forced deactivation. We will not remotely disable, deactivate, degrade or remove copies of the Plugin already installed on your Sites, and we will not use any kill switch or remote-disable mechanism to do so.
- Pro features keep working. Where discontinuation means that the licence-activation service is switched off, we will, before it is switched off, publish a final release of the Plugin that does not require licence activation, so that Pro features you have already paid for continue to work on your Sites. This commitment applies notwithstanding any provision of the Reseller’s EULA stating that paid features may be disabled following termination or cancellation.
- Continued use. You may continue to use the version you have installed, indefinitely, on the Sites where it is installed, in accordance with the GPL.
- No further updates or support. From the date of discontinuation you will no longer receive updates (including security and compatibility updates) or support, and the customer portal may be switched off.
You acknowledge that continuing to run software that is no longer maintained is at your own risk, in particular as regards compatibility with future versions of WordPress, PHP or third-party services, and security.
10.3 No warranty of continuity
Nothing in these Terms constitutes an undertaking to maintain, update or support the Plugin for any minimum period beyond the entitlements of a Subscription already paid for, subject always to Section 10.2.
11. Warranty disclaimer
To the fullest extent permitted by applicable law, and consistent with the GPL, the Plugin is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
In particular, we do not warrant that the Plugin will be error-free or uninterrupted, that it will be compatible with every theme, plugin or hosting environment, that indexing or answers will be accurate, complete or suitable for any particular purpose, or that it will meet any specific business result.
12. Termination
You may stop using the Plugin at any time and cancel your Subscription from your customer portal.
We may terminate your entitlement to updates and support, and deactivate your Licence Key, with immediate effect, if you materially breach these Terms — in particular Section 9 — or if payment is charged back or reversed. Consistent with Section 3.1, termination does not affect your GPL rights over code already in your possession, and we will not disable software already installed.
13. Limitation of liability
To the fullest extent permitted by applicable law:
- our total aggregate liability arising out of or in connection with the Plugin and these Terms shall not exceed the amount you actually paid to us (or to our Reseller) for the Pro licence in the twelve (12) months preceding the event giving rise to the claim;
- for the free version, which is supplied at no charge, our liability is limited to the maximum extent permitted by law;
- we shall not be liable for indirect or consequential loss, loss of profit, loss of revenue, loss of business or goodwill, loss of data, or for costs charged to you by an AI Provider, however arising.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law — including, for consumers, mandatory statutory rights.
14. Consumers
14.1 Business and consumer customers
The Plugin is primarily intended for professional use. Where you purchase as a consumer (a natural person acting for purposes outside your trade, business or profession), the mandatory provisions of consumer law applicable in your country of residence apply, and nothing in these Terms deprives you of them.
14.2 Right of withdrawal for digital content
For consumers in the European Union, the statutory 14-day right of withdrawal applies to distance contracts. As the Plugin is digital content supplied immediately upon purchase, at checkout you are asked to give your express consent to immediate performance and to acknowledge that you thereby lose your right of withdrawal once download begins, in accordance with Article 16(m) of Directive 2011/83/EU.
Independently of this, our 30-day money-back guarantee (Section 5) applies as a contractual commitment that is more favourable to you.
15. Data protection
We process personal data relating to your purchase and support requests as described in our Privacy Policy.
The Plugin does not send your website content, your knowledge base or your visitors’ conversations to us. In respect of your website visitors, you are the data controller: it is your responsibility to inform them, to obtain any required consent, to publish a privacy policy, and to select an AI Provider whose terms are compatible with your obligations.
16. Changes to these Terms
We may amend these Terms to reflect changes in the Plugin, in our commercial arrangements, or in applicable law. The updated version will be published on this page with a new “Last updated” date and will apply to purchases and renewals made after publication.
For material changes affecting an active Subscription, we will give reasonable advance notice by email. If you do not accept the amended Terms, you may cancel your Subscription before the next renewal.
17. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy, the product EULA and the Reseller’s terms applicable to your purchase, constitute the entire agreement between us in relation to the Plugin.
- Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force.
- No waiver. Failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or transfer of the business, without prejudice to Section 10.2.
- Force majeure. Neither party is liable for failure to perform due to events beyond its reasonable control.
18. Governing law and jurisdiction
These Terms are governed by the laws of Italy, excluding its conflict-of-law rules. The courts of [COURT / CITY], Italy, shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
Scope. This Section applies to disputes with BigFive concerning the Plugin and the subjects governed by these Terms. Disputes concerning the purchase transaction itself — payment, invoicing, chargebacks — are additionally subject to the Reseller’s EULA, which provides for the law of the State of New York and for arbitration. That clause binds you in relation to the Reseller; it does not extend the arbitration obligation to claims you bring against BigFive under these Terms, and it does not apply to the free version.
Where you purchase as a consumer resident in the European Union, this choice of law does not deprive you of the protection of the mandatory rules of the law of your country of residence, and you may bring proceedings before the courts of your place of residence. The European Commission’s online dispute resolution platform is available at ec.europa.eu/consumers/odr.
